TERMS & CONDITIONS
CLIENT SERVICES AGREEMENT: THIS IS A LEGALLY BINDING WORKING, RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT. Please read it carefully before agreeing to the terms.
Lisa Roah is a certified independent travel advisor affiliated with Fora Travel. If you are obtaining a quote for and/or securing travel for more than just yourself, all references below that reads “I” (and derivations thereof, including without limitation “you”) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote and/or securing travel.
I understand that the travel advisor is not the source or supplier of the travel services, hotel services, airline travel, or any third party operated excursion, tour or activity that I have requested, and acts solely as an agent to make reservations with the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the services I have purchased. I consent to and request the use of those suppliers and agree not to hold travel advisor responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience. The travel advisor can accept no responsibility for losses, additional expenses, or harm due to delay, cancellations or changes in air, sea or other services, breakdown in machinery or equipment, technology problems or changes in fares, sickness, weather, supplier default, supplier negligence, bankruptcy, strike, war, quarantine, fire, acts of government or other authorities, and any acts of terrorism, piracy, civil unrest, riots or thefts.
I affirm that I am voluntarily participating in the travel services that the travel advisor has reserved and that the travel advisor is not responsible for special, indirect or consequential damages. I hereby agree to indemnify and hold Travel Advisor, Lisa Roah and Fora Travel Agency harmless from and against any and all claims, liabilities, and costs of any kind (including the costs of reasonable attorney’s fees and disbursements in defending such claims) to which they may be subject by reason of its negligence, the breach of this contract, or any other of its action. I understand that all reservation fares typically involve restrictions (including, but not limited to, restrictions related to cancellation) and that changing any aspect of my travel arrangements may result in additional payments being owed.
I understand that the Transportation Security Administration (TSA) requires me to carry required government-issued identification in order to board a flight. I have been advised that the name, date of birth and gender that appears on the identification card must exactly match the same name that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight. I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas. I take full responsibility and must determine the proper entry requirements when traveling internationally. This includes passports, visas, vaccinations, legal authorization, and any documents that may be required such as a minor traveling without parents. All passengers are required to have a valid passport to travel. Passports should be valid for at least six months after the return date. Traveler assumes complete and full responsibility for, and hereby releases Travel Agency from any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. It is the passenger’s responsibility to have proper passports or government-issued IDs as well as visa’s where required. It is the traveler’s responsibility to be informed of any state department warnings where they are traveling and to be aware of any health risks and take the appropriate precautions.
I have been advised to obtain appropriate travel insurance coverage against risks and non-refundable costs. By embarking upon travel, I voluntarily assume all risks involved in such travel, whether expected or unexpected. I am hereby warned of the above risks as well as possible travel industry bankruptcies and medical, climatic, and other disruptions, and the possibility that I may be unable to travel as scheduled because of personal emergency or otherwise. Pre-existing medical waivers may only be available within 14 days of booking. Please note that most insurance policies have a specific clause stating they do not cover epidemics/pandemics especially when travel warnings are in place. No representation or description of insurance constitutes a binding assurance about insurance. I agree to hold the travel advisor harmless for my election NOT to purchase travel insurance or for any denial of claim by travel insurer.
I will review my documents, including cancellation/change policies, when I receive them and notify the travel advisor of any discrepancies. It is my responsibility to have appropriate documents for identification and to be aware of any cancellation penalties for each supplier. Cancellations may incur a full payment penalty. Deposits may be non-refundable. Suppliers may require pre-payment, an incidental hold on a credit card or other pre-authorization charges, and it is my responsibility to make sure my credit card is ready for these charges.
I am aware that travel documents may be issued by Expedia TAAP, Tablet, a representation company, a DMC and other suppliers. Travel reservations may be booked through a host agency. The travel Advisor, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers or travelers' companions or group members. Travel Advisor's role is to make travel reservations for me upon my request and there is no guarantee of such supplier's rates, bookings, quality of accommodations, cruise, tours, transportation, reservations, connections, scheduling, special requests, or handling of baggage or other personal effects. The travel advisor has my authorization to use my personal information for bookings, airfare/airline tickets, tours, cruises, restaurant reservations and any other reservation requested by me. I am aware that there may be currency fluctuations that may affect the final amount due for my reservations. I am responsible for due diligence and being aware of the quality of the hotel accommodations, tour operators and other suppliers chosen by the traveler. I agree that the travel advisor will not be responsible if I am not satisfied with my choices.
I understand that the travel advisor may not be able to return my calls, schedule consults, or return emails outside of normal weekday business hours and that normal response times are 24 hours. If there are any issues that come up during my travels, I will contact the hotel/supplier/operator directly so they can be resolved in a direct and timely manner and will keep the travel advisor involved so that she can follow up as needed for reschedules, cancellations and refunds. Please also note that services provided by a hotel services such as concierge or housekeeping is outside the scope of travel advisory services.
My request for services/reservations, email consent or signature (any of these three) indicates my consent to all the terms of this agreement, for myself and for every person traveling with me, for all trips requested by me, now and in the future, whenever booking travel through Lisa Roah and Fora Travel Inc.
